General Terms and Conditions of Tabea Zimmermann (TZ Designs)

1. General

1.1 Customers within the meaning of these General Terms and Conditions (GTC) can be either consumers or entrepreneurs.

1.2 An entrepreneur is a natural or legal person or a legally capable partnership that, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity. A legally capable partnership is a partnership that has the capacity to acquire rights and incur obligations.

1.3 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or independent professional activity.

2. Prices and Shipping Costs

All prices are total prices including VAT or taxed under the margin scheme according to § 25a UStG plus shipping costs. Costs for packaging and shipping are specified in the respective offer.

3. Retention of Title

The goods delivered by the seller remain the property of the seller until full payment has been received.

4. Payment Methods; Delivery; Delivery Restrictions; Shipping Costs; Transfer of Risk

4.1 The following payment methods are generally available in our shop:

Advance Payment (Prepayment)
If you choose advance payment, we will provide our bank details in a separate email. Delivery will occur after payment has been received.

Delivery Time and Restrictions
Delivery will be made within 7–10 working days (Monday to Friday, excluding public holidays) after receipt of the payment order by the transferring financial institution (for advance payments).
If there are delivery restrictions for a product, these will be indicated in the product listing.

Shipping Costs
Delivery is made according to the shipping costs specified in the respective product description.

4.2 Transfer of Risk

  • If the customer is a consumer, the seller bears the risk of shipment regardless of the shipping method.

  • If the customer is an entrepreneur, all risks and dangers of shipment pass to the customer as soon as the goods are handed over to the contracted logistics partner.

5. Right of Withdrawal

If you are an entrepreneur (see Section 1.2 of these GTC) within the meaning of § 14 BGB, there is no right of withdrawal. The following applies to consumers:

Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, takes possession of the goods.

by a clear statement (e.g., a letter sent by post, phone, fax, or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient that you send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal
If you withdraw from this contract, we must reimburse all payments received from you, including delivery costs (except for additional costs resulting from choosing a delivery method other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal.

We will use the same payment method that you used in the original transaction, unless expressly agreed otherwise with you. In no case will you be charged fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or you have provided evidence of having sent back the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you communicate your withdrawal. The period is considered met if you send the goods before the period of fourteen days expires.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if the loss in value is due to handling the goods in a way not necessary to check their nature, characteristics, and functioning.

6. Notes

6.1 The right of withdrawal does not exist, unless otherwise agreed, for the following contracts:

  • Delivery of goods not prefabricated and made according to individual selection or specification by the consumer, or clearly tailored to the personal needs of the consumer.

  • Delivery of perishable goods or goods whose expiration date would be exceeded quickly.

  • Delivery of alcoholic beverages if the price was agreed at the time of the contract, but the goods can only be delivered after 30 days and the value depends on market fluctuations beyond the seller’s control.

  • Delivery of newspapers, magazines, or periodicals, except for subscription contracts.

The right of withdrawal expires prematurely, unless otherwise agreed, for:

  • Delivery of sealed goods that are not suitable for return for health or hygiene reasons if the seal was removed after delivery.

  • Delivery of goods that are inseparably mixed with other goods after delivery due to their nature.

  • Delivery of audio or video recordings or software in sealed packaging if the seal was removed after delivery.

6.2 Please avoid damage and contamination of the goods. Return the goods preferably in the original packaging with all accessories and components. Use protective packaging if necessary. If the original packaging is no longer available, ensure adequate protection against transport damage.

6.3 The above does not affect the effective exercise of the right of withdrawal.

7. Compensation for Diminished Value upon Withdrawal

In the event of withdrawal, the customer must compensate for any diminished value if it results from handling the goods beyond what is necessary to check their nature, characteristics, and functioning, provided that we informed the customer about the right of withdrawal in accordance with Art. 246a § 1 para. 2 sentence 1 no. 1 of the Introductory Act to the BGB.

8. Liability for Defects; Warranty Rights; Liability

All our goods are subject to statutory warranty rights. Liability and warranty follow statutory provisions.

The warranty period for used items is 12 months. Claims for damages remain unaffected. Any manufacturer warranties do not limit statutory warranty rights.

9. Consumer Information for Distance Contracts for the Purchase of Goods

9.1 The seller is not subject to any special or above-mentioned codes of conduct.

9.2 Essential features of the goods and validity periods for limited offers can be found in the respective product descriptions. The language available for the contract is exclusively German.

9.3 Complaints and warranty claims can be submitted to the address provided in the provider identification. Payment, delivery, or fulfillment information is provided in the offer.

9.4 Ordering via Shopping Cart
Add the selected items to the shopping cart. After selecting all items, proceed to checkout or choose Express Checkout with PayPal.

Checkout Process
Existing customers can log in with email and password. New customers must provide contact details, choose shipping address, shipping method, and payment method, then submit the order by clicking “Place Order.” You can review and correct your entries before submitting the order.

1-Click® Orders
1-Click® ordering is available via Amazon login. Orders are automatically sent to the registered address using the selected payment method. Multiple 1-Click® orders within 30 minutes are combined into as few shipments as possible. Cookies must be accepted to use this feature.

10. Final Provisions

10.1 The law of the Federal Republic of Germany applies. Consumer protection laws of the country of residence remain unaffected. UN Sales Law is excluded.

10.2 Should any provisions be invalid or not part of the contract, the remaining provisions remain valid.

11.2 We are not obliged or willing to participate in dispute settlement before a consumer arbitration board.

12. Image Rights

All image rights belong to TZ Designs. Any use without explicit consent is prohibited.

Warranty Conditions

If a warranty is indicated in the product description, TZ Designs guarantees it. The duration starts upon receipt of goods.

The warranty covers defect-free products, including functionality, material, or production defects.
